Telephone Solicitations and DO NOT CALL Compliance
It is the policy of RMAA to comply fully and completely with all federal and Georgia state laws and regulations regarding telephone solicitations.  Federal and Georgia law and regulations prohibit the making of unsolicited telephone sales calls to homeowners who have entered themselves on the National Do Not Call (“DNC”) list.  The Company also maintains an in-house DNC list. It is the responsibility of every employee or licensee to check both lists and to be certain not to make an unsolicited sales call to a person on either list.  If the Company is fined due to a violation of the DNC laws and regulations, the Associate is responsible for the fine and will be billed accordingly.
 
The FTC has a fully automated and secure website — telemarketing.donotcall.gov — to provide access to the National Registry’s database of telephone numbers, sorted by area code. 
The National Do Not Call registry requires a fee, which must be paid by the Associate. For fiscal year 2020, the annual fee is $66 for each area code of data accessed or $18,044 for access to every area code in the registry, whichever is less. The first 5 area codes of data may be accessed at no charge.

You may call when there is an established  business relationship.
Employees and licensees may call a consumer with whom they have an established business relationship, provided the consumer has not asked to be on the Company’s in-house Do Not Call list. An established business relationship is based on either: (1) the consumer’s use of the employee’s or licensee’s services within 18 months preceding a telemarketing call (the 18-month period runs from the date of the last transaction between the consumer and the employee or license) OR (2) a consumer’s inquiry or application regarding an employee’s or licensee’s services and exists for three months starting from the date the consumer makes the inquiry or application. This enables employees or licensees to return calls to interested prospects even if their telephone numbers are on the National Registry.  In accordance with federal and State of Georgia laws and regulations, it is this Company’s policy to:

• Maintain its own DNC list comprised of persons who have requested that their telephone numbers not be called for telephone solicitation.  Each entry shall be retained on the list for at least 5 years, or until we receive a written request from the consumer that the number be deleted from the list.  A copy of the in-house DNC list is also maintained at the Office and is available for inspection at the Office.
• Require all employees and affiliated licensees to undergo periodic training with respect to the DNC laws and regulations, and with respect to Company policy regarding the same.  Further, employees and licensees are supervised and monitored whenever possible with respect to compliance with all Company policies regarding telephone solicitations.  Any employee or affiliated licensee who violates the law, fails to participate in regular training, or fails to comply with the Company’s DNC policy, will be subject to discipline, which may include a fine and/or termination.
• Require employees and licensees, before making any telephone calls, to first verify that the number does not appear on either the National or the in-house DNC list.
• Require that any employee or licensee of the Company making telephone solicitation calls (to a number that is not on either DNC list):
  • make calls only between the hours of 8:00am and 9:00pm
  • at the beginning of the call, politely identify themselves by providing their first and last name, state that he or she is calling on behalf of the Firm and explain the nature of the call.
• Require that all employees and licensees transmit or cause to be transmitted the telephone number, and, when available by their telephone Company, the name of the employee or licensee to any consumer’s caller identification service.
• Require that any employee or licensee, upon receipt of a request from a consumer that their telephone number be added to our DNC list, provide, in writing, the consumer’s name and telephone number to the Office within 24 hours of receipt of said request.  The Office shall add the number to the in-house DNC list as quickly as possible, but in no event later than 30 days from the date of the receipt.
• Provide, as quickly as possible upon request from any consumer, a copy of this DNC policy, by mailing same to the address provided by the consumer.
• Require any employee or licensee upon receipt of any request from a consumer regarding the Company’s DNC policy to forward the request to the Broker within 24 hours of receipt of said request.
• Retain Company records regarding compliance with these procedures for a period of 24 months.
